The following terms and conditions are the rules by which you agree to be bound when purchasing a Product from Style Hatch. You agree that you are legally bound by these terms and conditions when you successfully purchase a Product; or when you use or make use of any purchased Style Hatch Product.

For the purposes of these terms and conditions the definitions below apply whenever a term is capitalized, or in uppercase and underlined.

  • “Date of Purchase” means the date on which a commercial transaction with Style Hatch occurs.

  • “End Product(s)” means a single instance of a Style Hatch theme having been installed for a personal or commercial project.

  • “Intellectual Property Rights” means any and all proprietary rights, titles, and interests, including, but not limited to, trademarks, patents and copyrights, as existing and recognized anywhere in the World on the Date of Purchase.

  • “Style Hatch” means Style Hatch, Inc.

  • “Product(s)” means any paid for item, subscription, or service offered by Style Hatch.

  • “Product Update(s)” means subsequent updates to a Product released by Style Hatch for the purposes of, but not limited to, fixing bugs or adding features.

  • “Supported Browser(s)” means, subject to an express statement to the contrary, the most recent stable release version of Chrome, Firefox, or Safari; and Internet Explorer 11 and above.

  • “Unsupported Browser(s)” means any browser not listed as a Supported browser.

Individual Theme Purchase

Themes are licensed to use for a single store only, whether the themes are published or not. You are free to transfer a Theme to a second one of your own stores if you close your first store. To initiate a transfer of a Theme to a second one of your stores, please email help@stylehatch.com. You are not permitted to transfer or sell a Theme to any other person’s store on Shopify or elsewhere. Multiple stores require multiple downloads and each download is subject to the applicable fee. Style Hatch, Inc gives no assurance that a particular Theme will remain available for additional downloads.

You may modify the Theme to suit your store. While our support team does its best to accommodate requests for custom development help, this is not a service that we guarantee.

The intellectual property rights of the Theme remain the property of Style Hatch, Inc. If you exceed the rights granted by your purchase of a Theme, Style Hatch, Inc may take legal action against you, and Shopify may take administrative action such as modifying your store or closing your store.

You may not share, resell, barter, trade or give away Style Hatch code in whole or part, with or without modification to any third party. If Style Hatch discovers unauthorized distribution of its intellectual property, the original license may be voided without refund and all stores using the original code or unauthorized copies must cease using them immediately.

It is the responsibility of the user, and not Style Hatch, Inc, to ensure that the installation of a new theme does not overwrite or damage the current or preexisting theme, or UI, of the user.

Theme Updates

Our Themes are designed and optimized to work with the Shopify platform. We work hard to ensure our Themes are completely bug free, however if problems are discovered we encourage you to report any issues to help@stylehatch.com. We frequently address bugs and optimization efforts through Product Updates. Purchasing a Theme license enables you to access future Theme updates at no additional cost.

Warranty and Limitation of Liability

You expressly understand and agree that Style Hatch shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use our products.

Our Themes are sold and provided "as is." We don't guarantee that they will function exactly as you wish or be compatible with third party plugins or apps from the Shopify App Store.

Neither Style Hatch, nor any of our affiliates, independent contractors or employees will be liable or have responsibility, of any kind, for any loss or damage, of any kind, that you incur because of an interruption or failure of your website or use or misuse of our products. We will not be liable or have responsibility for any third-party attacks, viruses, or malicious software that may affect your website or your computer.

Style Hatch does not guarantee that its themes are compliant with any local, national or international laws or regulations, including but not limited to the Americans with Disabilities Act, General Data Protection Regulation or Children's Online Privacy Protection Act. By purchasing or using Style Hatch Themes, you are accepting sole responsibility for compliance with any laws or regulations. Style Hatch cannot advise store owners on compliance issues.

Style Hatch is not liable and provides no warranty for any errors, bugs, conflicts, or incompatibilities with Themes arising from improper installation of the Theme; or any use of the Theme for any purpose other than that for which it was being offered by Style Hatch; or the concurrent use of third party products or services, as reasonably determined by Style Hatch; or any and all changes or modifications to the Theme after the Date of Purchase; or for any errors, bugs, conflicts, or incompatibilities which arise exclusively on Unsupported browsers.

Browser and Device Compatibility

Although we do not guarantee compatibility on any device or browser, we strive to build our themes to be compatible with the most common modern browsers including the latest versions of Firefox, Safari, Chrome, Microsoft Edge and Internet Explorer 11, though, in many cases, not all features will be available in Internet Explorer browsers. We also test our Themes on various mobile, tablet, and desktop devices.

We are also unable to guarantee that our Themes will pass W3C, Google PageSpeed Insights or other validation services.

Any device or browser specific problems should be reported to help@stylehatch.com.

Changes

We reserve the right to make changes to our terms and conditions or our prices without notice. Where allowed by law, changes made to our terms and conditions become retroactively applied to all customers, no matter when the purchase was processed.
